The short version
- Holding Hands helps families stay organized. It isn't medical advice, and reminders can be late or missed, so don't rely on it alone for anything urgent. In an emergency, call 911.
- It's for family caregivers, not healthcare providers, agencies or facilities.
- Your information is yours. It lives in your iCloud, and you decide who sees it.
- Plus is sold and billed by Apple, and you manage it in your Apple Account.
These terms are an agreement between you and DevScape.io LLC ("DevScape", "we", "us") about the Holding Hands app for iPhone, iPad and Mac (the "app"), Holding Hands Plus, and holdinghands.app (together, the "service"). By using the service, you agree to these terms and to our Privacy Policy. If you don't agree, don't use the service.
1. What Holding Hands is, and isn't
Holding Hands is an organizing tool. It helps a family keep track of medications, appointments, tasks, notes and documents for someone they care for.
- It isn't medical advice. Holding Hands doesn't diagnose, treat or recommend doses, and it doesn't check for drug interactions. It isn't a medical device. Always follow the instructions of the person's doctors and pharmacists.
- Reminders are best effort. Notifications depend on your devices, their settings, iCloud and your network. They can arrive late or not at all. Don't rely on Holding Hands as the only way to make sure a dose is given or an appointment is kept.
- Smart features can be wrong. Visit recaps, the weekly digest, med-list scanning and medication suggestions are drafts. Check them against the original source before you rely on them.
- The Emergency Card is only as current as your family keeps it. Make sure the information in it is accurate.
In an emergency, call 911 or your local emergency number.
2. Who can use it
You must be at least 13 years old. If you're under 18, a parent or guardian must agree to these terms for you. Holding Hands is for personal, family use. It isn't meant for healthcare providers, home-care agencies, facilities or other professional care services, and we don't sign business associate agreements under HIPAA. If you're a professional caregiver, you may use it only as a member of a family's circle, at the family's invitation.
3. Your information
You own the information you put into Holding Hands. It's stored in your iCloud account, and we don't have access to it. You're responsible for:
- Having the right to record and share information about the person you care for, such as their permission, or legal authority like a power of attorney where it's needed.
- Choosing who to invite to a circle, and whether each person can edit or only view. Anyone you invite can see everything in that circle.
- Keeping your Apple Account and devices secure.
- Keeping your own copies of anything important. You can export documents and care summaries from the app. Because your data is in your iCloud and not with us, we can't recover it if it's deleted or lost.
Holding Hands requires an Apple Account with iCloud. Your use of iCloud is covered by Apple's terms, and iCloud storage limits apply.
4. Holding Hands Plus
- Sold by Apple. Plus is purchased through the App Store and billed to your Apple Account. Apple's terms of sale apply.
- Per person cared for. Each plan covers the number of people you choose. Everyone in a covered person's circle gets Plus features at no extra cost.
- Coverage follows the payer. If the person paying for a plan leaves the circle, or their plan ends or covers fewer people, Plus features may stop for that circle. When a plan covers fewer people, the most recently covered person loses Plus first.
- Renewals. Monthly and annual plans renew automatically unless you cancel at least 24 hours before the end of the current period. Free trials turn into paid plans unless you cancel before the trial ends. Manage or cancel in your Apple Account's subscription settings.
- Lifetime. A Lifetime purchase covers one person for as long as we offer Holding Hands Plus. It isn't a subscription and doesn't renew.
- Refunds are handled by Apple under its policies.
- Changes. We may change prices or which features are in Plus. A price change won't affect a period you've already paid for, and Apple will tell you before a subscription renews at a higher price.
5. The beta
- Beta versions distributed through TestFlight are unfinished. They may have bugs, change or stop working, or lose data. Keep copies of anything important.
- Purchases made in a TestFlight version aren't charged, and they don't carry over to the App Store version.
- Free year of Plus. The first 100 people who sign up for the beta through holdinghands.app get one year of Holding Hands Plus for one person cared for. We decide eligibility from the order of sign-ups, one offer per person. We'll email you how to redeem it, and it must be redeemed through the App Store under Apple's terms. It can't be exchanged for cash or transferred, and it's void where prohibited.
- Feedback you send us, through TestFlight or by email, may be used to improve Holding Hands without any obligation to you.
6. Acceptable use
Don't use Holding Hands to break the law, to record information about someone without the right to, to harass anyone, or to store content you don't have the right to share. Don't try to reverse engineer, disrupt or misuse the app, its iCloud data or the website, including the beta sign-up form.
7. Our rights
The app, the website, and the Holding Hands name and icon belong to DevScape. We give you a personal, non-transferable license to use the app on Apple devices you own or control, under these terms and the App Store's usage rules. We may update, change or discontinue features, or the service, at any time.
8. Apple
These terms are between you and DevScape, not Apple. Apple isn't responsible for the app or its content, and has no obligation to provide maintenance or support for it. If the app fails to meet a warranty that applies to it, you may notify Apple for a refund of the purchase price, if any. To the extent the law allows, Apple has no other warranty obligation. Apple isn't responsible for claims about the app, including product liability claims, claims that it fails to meet legal or regulatory requirements, consumer protection claims, or intellectual property claims. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you. You confirm that you're not located in a country subject to a U.S. government embargo and that you're not on a U.S. government list of prohibited or restricted parties.
9. Disclaimers
The service is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, accuracy and non-infringement. We don't promise that the service will be uninterrupted, error-free or secure, that notifications will be delivered, or that information in it will be accurate or complete.
10. Limitation of liability
To the fullest extent the law allows, DevScape won't be liable for any indirect, incidental, special, consequential or punitive damages, or for lost data, missed doses or appointments, or health outcomes arising from your use of the service. Our total liability for any claim about the service is limited to the greater of the amount you paid for Holding Hands Plus in the 12 months before the claim, or $50. Some places don't allow these limits, so they may not all apply to you.
11. Indemnity
If someone brings a claim against us because of information you put into Holding Hands, how you shared it, or your breach of these terms, you agree to cover our reasonable costs of that claim, to the extent the law allows.
12. Ending your use
You can stop using Holding Hands at any time by deleting the app and its iCloud data. We may suspend or end your access to the beta or the website if you break these terms. Sections 3 and 7 to 13 continue to apply after your use ends.
13. Governing law and disputes
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute will be brought in the state or federal courts located in Texas, and you and we agree to their jurisdiction. Before filing a claim, please email us so we can try to resolve it informally. This doesn't limit rights you have under the consumer protection laws of where you live.
14. Changes to these terms
We may update these terms. We'll change the date at the top of this page, and for significant changes we'll tell you in the app or by email before they take effect. If you keep using the service after that, you accept the updated terms.
